INFORMATION ON “MIXED WORKS” AND THE DOCUMENTATION OF WORKS ALREADY REGISTERED AT OTHER ORGANIZATIONS
Mixed works are works with multiple authors, that include authors represented by Artisjus and also authors not represented by Artisjus, but instead by other collective rights management organizations.
In order to register such works for royalty distribution and payment purposes authors who mandated Artisjus with managing at least some of their rights must register their mixed works at Artisjus according to the following procedure:
If the work was not registered at foreign rights management organizations, it must be registered at Artisjus like all the other domestic works.
Works must be registered with Artisjus in accordance with the Mandate Agreement using the Artisjus work registration form, providing actual shares signed by each of the authors (including authors represented by foreign rights management organizations), with the original signatures from every author, providing music publishing shares and attaching publishing contracts. http://www.artisjus.hu/opencms/export/download/szerzoknek/mubejelento.doc
Artisjus will register the work in international databases and liaise with the foreign rights management organizations regarding the validation of shares.
Because of the authors (also) represented by foreign rights management organizations, work registrations must also be submitted to foreign rights management organizations, as it may be a prerequisite to foreign royalty payments. It is very important that the content of the work registrations (authorship and publishers’ share in particular) be identical.
Authors who mandated Artisjus with managing at least some of their rights must submit a work registration for works already registered with foreign rights management organizations to Artisjus if the works were registered after the start of the Artisjus mandate.
Works must be registered with Artisjus in accordance with the Mandate Agreement using the Artisjus work registration form, providing actual shares signed by the author represented by Artisjus, listing any other mandated foreign rights management organizations, providing music publisher shares and attaching publisher contracts for publisher shares.
Works can only be registered if the basic data (title, duration, etc.) and authorship shares can be matched with the foreign registration. Artisjus will liaise with the foreign rights management organization regarding the data.
Authors who mandated Artisjus with managing at least some of their rights need not submit a work registration for works already registered with foreign rights management organizations to Artisjus if the works were registered before the start of the Artisjus mandate, and the author submitted a confirmation to Artisjus regarding the foreign work registration.
In this scenario Artisjus documents the work based on information received from the international database (CISNET) and the foreign organization, and requests statement from the represented author declaring that the authorship and music publisher shares are accurate.
Author must submit a statement to Artisjus declaring that the data (rightholders’ share) on the work list compiled based on foreign work registrations are accurate.
Works where such a confirmation cannot be submitted should be registered according to Point 1.
